Retribution refers to "just deserts" and "an eye for an eye." According to the textbook,Corrections Today(2014), the goal of retribution is to impose punishment that holds the offender accountable and that is proportionate to the crime. Retribution is not concerned with future outcome, only that the offender is held accountable and that the appropriate punishment is granted (Siegel & Bartollas, 2014). A first-time nonviolent offender, then, should be treated less severely than a repeat offender. Mandatory minimum sentencing laws seem to be perfectly aligned with the goal of retribution. Laws such as three-strikes and truth in sentencing result in harsher penalties for repeat and/or violent offenders. "The primary purpose of indeterminate sentences remains an effort to individualize each sentence in the interest of rehabilitating offenders" (Siegel, 2017). Indeterminate sentencing achieves the purpose because it allows for flexibility in both the sort of punishments issued and the amount of time that must be served. States that use indeterminate sentences frequently use statutes that set minimum and maximum sentences while allowing judges to decide the actual punishment within these parameters. Rehabilitation is utilized behind the belief that "they will refrain from further criminal activity if they can be successfully helped and treated rather than condemned and punished" (Siegel, 2017). This allows new approaches to punishment because crimes and punishment are not "one-fit-all" scenarios. Some offenders need drug counseling, probation, or other methods that do not involved extended incarceration. This allows the system to reduce recidivism, lower incarceration rates, and reform criminals into functioning, law-abiding citizens.
