SCENARIO
You are a registered migration agent and in light of the recent announcements by the Government to stop worker exploitation, you have been conducting information sessions for employers who have already sponsored or are planning to sponsor employees. The sessions are online and you have been having a big turn-out of around 50 employers. One thing that caught you by surprise was the consistent questions in the chat box during the session. Some employers became frustrated and logged off.
After finishing one of the sessions, you ask the participants to contact you if they had any further questions. Unfortunately, you only received one enquiry from Stella Mavericks, the Director and owner from Outback Australia who manages a number of restaurants in regional Australia. They specialise in Australian delicacies and are in the Good Food Guide as some of the top restaurants to visit. Stella is uncertain what sponsorship obligations apply to her if she sponsors employees for the Skilled Employer Sponsored Regional (Subclass 494) visa and supports them through to Permanent Residence (Skilled Regional) (Subclass 191) visa.
Prepare a letter of advice for Stella as Director of Outback Australia outlining any sponsorship obligations that they must consider as a sponsor for employees for the Skilled Employer Sponsored Regional (Subclass 494) visa and supporting them through to Permanent Residence (Skilled Regional) (Subclass 191) visa. In your letter of advice provide practical examples to demonstrate each of the sponsorship obligations. You are also required to discuss any consequences for not meeting the sponsorship obligations.
Your answers must be supported by references to relevant legislative and/or regulatory provisions.
