Question Presented
Sue was appointed as a Member of the National Cultural Heritage Committee under s 17(1)(c) of the Act, on the recommendation / nominee of Minister administering the Aboriginal Land Grant (Jervis Bay Territory) Act 1986. However, her appointment was later terminated under s 18(2) of the Act by ‘the administering Minister’ on request of the former Minister. The legal advice is sought on whether such termination of appointment as a Member is legally correct considering Sue was neither physically or mentally incapacitated, nor had engaged in any misbehavior or questionable activity discouraged by the Act.
