The CIO is also concerned that if he decides to proceed with a cloud-based storage system, BROLGA must need to use the Cloud Services Panel to procure the storage. The Cloud Services Panel was formed to provide cloud services. Cloud Services Panel companies are eligible to provide platform to the Public Governance, Performance and Accountability Act 2013 and other agencies listed in the Head Agreement. The Cloud Services Panel also includes a variety of business models including Software as a Service (SaaS), Platform as a Service (PaaS), Infrastructure as a Service (IaaS) and Specialist Cloud Services (SCS). Similarly, section 7.6 and 7.7 of AusTender from the Commonwealth Procurement Rules, 2019, explains that AusTender, the procurement Australia government information system is a consolidated network-based platform that provides a set of information, such as the proposed procurement process of specific agencies, open tenders and key contract details. It also facilitates safe digital tendering to provide related agencies and prospective suppliers with transparency and performance. AusTender is the system that allows related bodies to satisfy their publication duties under the CPRs. It also helps related bodies to track and evaluate their procurements centered on AusTender, covering industry strategies, contract publishing and contract adjustments.
The CIO of BROLGA has had a quotation from Emily’s Big Tower of Cloud Pty Ltd that they will provide an annual fee of $220,000 over the corresponding twelve year period. This indicates the properties of the limited tender which is mention in the section 9.9 of Procurement method from the Commonwealth Procurement Rules, 2019. Limited tender process entails a particular agency asking one or more possible suppliers to submit applications where the open tender process does not follow the rules and standards. It is therefore proposed that when BROLGA issues a tender for cloud-based storage, BROLGA may only issue the tender to Emily’s Big Tower of Cloud Pty Ltd.
There is a serious issue that BROLGA cannot sign a contract with a single six-year extension option for an initial six-year period because, according to the Digital Sourcing Contract Limits and Review Policy, each digital contract must not exceed the initial three-year term and each individual extension option must not exceed three years. Moreover, extension options can be pursued only after a review of the performance and deliverables of the contractor.
Furthermore, the Indigenous Procurement Policy (IPP) introduced on 1 July 2015, which extends to all non-Corporate Commonwealth bodies protected by the Commonwealth Procurement Rules. Hence, BROLGA is also a Non-Corporate Commonwealth Entity (NCCE), it must comply with the rules of the Indigenous Procurement Policy. The policy seeks to promote indigenous entrepreneurship and business development, and to provide certain incentives for indigenous businesses to compete in the community.
